1. I have reviewed the application and responses to the application dated 13/11/2024. Upon further hearing the counsel present and in the interests of expediting the substantive appeal herein, I allow the application dated 13/11/202 on condition that the applicant shall pay to the respondent the amount of KShs.35,000,000/= within the next 30 days.
2. In default of the stated payment being made within the 30 days, as ordered, the respondent shall be at liberty to execute for the total tax demanded without further reference to this Honourable Court.
3. In the intervening period the respondent shall file and serve their Statement of Facts within the same period of 30 days. Thereafter, parties to file and serve their skeleton submissions limited to 10 pages within 15 days each starting with the appellant. Compliance mention and for further directions on 5/3/2025.
