The Respondent’s application dated 30.09.2022 for stay pending appeal is allowed on the following terms:
1. There shall be a stay of execution and or enforcement of taxes consequent upon the judgment of this court on terms that the Respondent shall provide security in the form of a Bank Guarantee from a reputable Bank for Kshs. 2,500,000.00 within 30 days from date hereof.
2. In default of compliance, the stay shall stand discharged and the Appellant shall be at liberty to enforce collection of taxes.
3. The order of stay shall remain in force for the period of 1 year unless otherwise extended by this court or the Court of Appeal.
