High Court at Milimani High Court · · Visram Aleem Alnashir

1. I have considered the amended notice of motion application dated 4th June 2024, together with the affidavit filed in support of the same.

2. I note that no opposition to the application has been filed to date. A return of service is available in the court file.

3.  The application is made pursuant to section 916 and 917 of the Companies Act and seeks to restore the first respondent to the register of companies on the basis that tax remains outstanding and payable by the 1st respondent to the applicant.

4. Further, the first respondent failed to apply for deregistration of its tax obligations prior to its removal from the companies register, and the applicant was not aware of its deregistration at the time.  Accordingly, the applicant seeks to restore the respondent to ensure the outstanding obligations are settled.

5. Based on the reasons set out on face of the application and further grounds set out in the body of the motion and in the supporting affidavit, I find it appropriate to allows the same as prayed for.

6. The same is accordingly allowed with costs.

The file is marked as closed.
