1. The lower court file is yet to be traced despite and undertaking by Mr. Anthony Michika the in charge of the high court civil registry to avail the same.

2. I do note that the record of appeal and the supplementary record of appeal contains the record of the lower court wherefore I direct that the appeal proceeds without the lower court file and in the event the same is traced it shall be placed in this appeal file.

3. The Appellant is directed to file and serve its submissions within 14 days from the date hereof and the Respondents to do so within 28 days.

4. Mention on 8/8/2024 to confirm compliance.
