RULING
1. In this matter, the property was subject of litigation known as CM SUIT No.25o of 2006.
2. In the proceedings, the Court did deliver a Judgement which included an eviction order dated 27.09.2006.
3. It is clear that even after the eviction order issued, the Defendants are still in occupation.
4. Currently, there is an Order against the Defendants issued on 22.11.2023.
5. The Defendant despite being aware of the Orders issued on 22.11.2023 and even filing a Notice of Appeal continue to enter and occupy the suit property in contempt of the Orders.
6. Consequently, the 1st, 2nd and 3rd Defendants are hereby summoned to attend Court on 11.03.2026 to explain why they should not be cited for contempt and sentenced accordingly.
7. In the meantime, this matter is adjourned from today’s hearing list and will proceed for hearing on 07.07.2026.
