KENYA COMMERCIAL BANK GROUP LIMITED VS MORARA EVANS NYANGONGO AND TOM MULATI WANJALA THE PRINCIPAL KISII NATIONAL POLYTECHNIC AND 1 Others

High Court at Kisii High Court · · Odera Teresa Achieng

'Before me is a notice of motion dated 19.9.25seeking orders that ;
1. Spent.
2. Spent .
3. THAT pending the hearing and determination of this application, the Honourable Court be pleased to issue an Order of Stay of Execution of the Court Order dated 16th September 2025;
The application is supported by the annexed supporting affidavit of Vincent Omari a retail bank officer of the applicant.
The application herein questions the issuance of garnishee orders by the lower court in CMCC No.E563 OF 2024 while there were stay of execution orders issued by this court on 16.9.25 in Civil Appeal No. E067 of 2025. I have already found that the respondent was in contempt of court orders by initiating the said garnishee proceedings while the status quo orders were in place . This application has thus been overtaken by events . Each party to bear his won costs .
