This is a matter that was heard and determined by the ELC Court Number 2. This has been, amidst the task of dealing with the files before it, been giving directions on applications in ELC Court Number 2 matters for the sake of keeping the matters in progress after the transfer of the Judge in that Court without replacement. However, the recent nominations of Judges for the ELC indicate that there will soon be a Judge posted to Malindi to deal with those matters, hence no further delay. Consequently, I hereby order that this matter be placed before ELC Court Number 2 on 20/5/2026 for the determination of the pending Preliminary Objection dated 29th January 2026.
