The Appellant in the application dated 16.05.2023 seeks stay of execution pending appeal from a decision of the Subordinate Court. Counsel for Respondent does not oppose the application in principle and urges that the decretal amount be deposited in court.
The application is allowed on terms that an order of stay of execution is issued on condition that the Appellant deposit the sum of Kshs. 900,000.00 in court within 14 days from the date hereof. In default the order of stay shall stand discharged,
