The Applicant’s application is dated 13.02.2023. It is made under section 21 rule 12 of the Civil Procedure Rules. The Applicant seeks to pay the judgment debt by monthly instalments of Kshs. 300,000.00. The application is opposed. I have heard the parties counsel and considering the circumstances of the case, I allow the application on the following terms:
1. The Applicant shall liquidate the judgment debt shall as follows:
(a) Kshs. 1,500,000.00 on or before 02.05.2023 and thereafter the payment of Kshs. 600,000.00 by the 5th day of every subsequent month until payment in full.
(b) In default of any installments, the entire balance shall fall due and the Respondent shall be at liberty to execute the judgment debt.
(c) The application dated 06.04.2023 shall be heard on 19.04.2023. In the meantime, there shall be no execution.
