I have considered the chamber summons application filed herein. From the disclosed facts an arguable case is established. I accordingly grant leave in terms of prayers 2 a, b, and c.
As regards the plea that the said leave operates as a stay, the outcome in this application will not be rendered nugatory as if successful, the applicant will have the criminal trial reinstated. Prayer 3 is declined.
The substantive motion be taken out in 21 days and served. Responses be filed in 14 days.
