By a notice of motion dated 15th April 2026 and supported by the affidavit of Modrix K. Wandallah ,the applicant seeks that Mumias SPM Succession No. 272A of 2018 be transferred to the high court for trial and determination. The application is grounded with an affidavit of Modrix K. Wandallah and grounds listed on the face of the Motion.
I have considered the motion. The assertion that the value of the estate is beyond the pecuniary limit of Mumias SPM court is not controverted. I find this a fit case to exercise my discretion and allow the motion in terms of prayer one of the application.
