Julius Ogogoh VS Mary Wambui Mungai

High Court at Milimani High Court · · Anthony Ndungu

 I have perused and considered the application dated 5th December 2022 brought under a certificate of urgency. The application seeks leave in terms of prayer 2(a) thereof to institute judicial review proceedings for an order of certiorari to quash the appointment of the respondent as chairperson of the Board of the Communications Authority of Kenya.

From the disclosed facts, and alive to the applicable legal threshold for the grant of such leave, ,and in consonance with the provisions of Order 53 Rule (1)(4), am persuaded that the question whether leave be granted and if granted the same operates as a stay of the impugned appointment should be canvassed inter partes. I direct as follows;

1. The chamber summons be served within 3 days hereof

2. Responses be filed within 7 days of service.

3. The matter shall be canvassed through skeletal written submissions.

4. The applicant to file submissions within 7 days of service of response.

5. The Respondent and Interested Party to file submissions within 7 days of service of rival submissions.

6.Mention 12.1.23 to confirm compliance.
