1. Indeed, a Notice to Show Cause why this matter should not be dismissed for want of prosecution was issued and served on the parties.
2. The matter was called out at 9:40am but the Appellants advocate were absent.
3. Based on the submissions of the Respondent Counsel and the proceedings before Court, it is true that the Appellant has never taken action since the year 2022.
4. Consequently, it is clear that the Appellant has lost interest in this matter.
5. As such, the Memo of Appeal dated 1.11.2022 be and is hereby dismissed for want of prosecution.
6. The Appellant is condemned to pay costs to the Respondent.
