RULING

1. This matter was filed to challenge an object to the distribution of the Estate of Hannah Jebii of Alfred Gimnyigei.
2. The Plaintiff who are grandchildren of Hannah Gimnyigei are opposing the transfer of the suit property and its distribution.
3. According to this Court, the property of the Estate of Hannah Tum and Alfred Gimnyigei were distributed and are not available for litigation in their original state.
4. The file is therefore transferred to the High Court to handle whether the said asset is available for litigation before this Court on the issues being raised by the Plaintiff are within the jurisdiction of the High Court.
5. The matter will be mentioned before the Presiding Judge High Court Eldoret for further directions on 22.09.2025.
6. In the meantime, the orders issued on 10.03.2025 as regards the inhibition are hereby reviewed and discharged.
