The Appellant seeks an order of stay of execution pending appeal from a decision of the Tax Appeal Tribunal. The application dated 10.05.2023 is allowed and a stay of execution of the Tribunal decision and collection of taxes on terms that the Appellant shall provide a bank guarantee from a reputable bank in favour of the Respondent for Kshs. 500,000.00 within 30 days from today.
The stay order shall remain in force for one year unless extended by this court. In default of compliance with the orders, the stay shall stand discharged.
Mention on 21.07.2023 to enable the parties proceed to ADR.
