RULING

1.   This matter relates to a portion of 28 acres within a property known as L.R.Turbo/West/Osongoria Block 3(Tapsagoi)/36 registered in the name of Nathan Kimaiyo Tarus.

2.   According to the Plaintiff Consent, the estate of Nathan Kimaiyo Tarus have since confirmed the distribution of the property known as Turbo/ West/Osongoria Block 3(Tapsagoi)/36 to the beneficiaries.

3.   Consequently, this Court is of the view and finding that the property Turbo West/Osongoria Block 3(Tapsagoi)/36 no longer exists to be capable of further  adjudication by this Court.

4.   Consequently, this file is hereby transferred to the High Court for the Succession Court to make the appropriate directions on the way forward in this file.

5.   The file will be placed before the Presiding Judge of the High Court on 23.03.2026 for the appropriate direction.
