JOSEPH WAIHURO MWAURA VS Insurance Regulatory Authority AND State Law Office AND 4 Others

High Court at Milimani High Court · · Bahati Mwamuye MBS

' The Petitioner/Applicant''s Notice of Motion Application dated 05/12/2025 is certified urgent as prayed for at Prayer No. 1.
The only other substantive prayer that remains in the Notice of Motion Application dated 05/12/2025 is that the Petition be certified as urgent. Having considered the Petition at a preliminary level, this Court is satisfied that the same is not so time-sensitive as to require the Petition itself be also certified urgent. Accordingly, Prayer No. 2 is declined.
On costs, the Application is one that is ripe for and is being summarily determined, and thus costs, if any, shall be in the cause.
The only remaining issue under the Application is the issuance of Directions, which the same shall be issued separately and in Chambers immediately after this Ruling.
The foregoing being fully determinative of the Petitioner/Applicant''s Notice of Motion Application dated 05/12/2025 the same be and is hereby fully determined by this Ruling dated 5th December 2025 with costs in the cause. Application partially allowed, costs in the cause.

DATED SIGNED AND DELIVERED VIRTUALLY ON THIS FIFTH DAY OF DECEMBER 2025.
