In the application dated 15.05.2023 the Applicants who are the directors of the Company which was the Appellant before the Tribunal seek leave to file the appeal out of time.The decision of the Tribunal was delivered on 28.02.2022 and the Applicants have not explained the reason for the delay which I consider inordinate in the circumstances. Further, counsel for the Applicant conceded that the appeal before the Tribunal did not concern the Company directors as urged by him. The Tribunal only dismissed the appeal in effect upholding the Objection Decision which concerned the Company.
The application dated 15.05.2023 is dismissed with costs of Kshs. 10,000.
