RULING

1. Looking at the Ruling pronounced on 12.10.2023, the Applicant was granted a stay of execution on condition that he deposits a sum of Kshs.350,000/- within 30 days.
2. The interpretation of this Ruling and condition is that the stay would only come in force once the Kshs.350,000/- is paid within 30 days.
3. Unfortunately, the Applicant failed to pay the amount of Kshs.350,000/- within the 30 days and therefore the stay never crystallized.
4. In other words, the Orders sought in this Application will review the Ruling of 12.10.2025 which the Court is not inclined to do.
5. Consequently, the Application dated 28.07.2025 is not merited and is dismissed with costs.
