RULING
1. The Court has gone through the Application and is of the view that the process under Section 78 of the Land Registrar Act is not complete.
2. Consequently, it is important for the Land Registrar to undertake the hearing envisaged in Section 78 and render its decision before this matter proceeds.
3. As such, the Land Registrar Uasin Gishu is directed to call for a hearing of the Request to lift the Restriction dated 29.01.2026 within 30 days from today’s date and render the decision within 45 days from today’s date.
4. The matter will be mentioned on 11.06.2026 to confirm if a decision has been made by the Registrar and if the Applicant still intends to proceed with this matter.
