The orders in HCCA 71 of 2023 made on 17th May 2024 as hereunder to apply herein Mutatis mutandis.
The application for stay of execution pending the hearing and determination of the appeal is allowed on condition that:-
1) Half of the decretal sum is paid to the respondent within 30 days hereof.
2) The other half of the decretal sum is deposited in a joint interest earning account in the names of the advocates for the parties within 30 days hereof.
3) The Record of Appeal be filed within 30 days hereof.
4) In default of (1) and (2) the stay to lapse automatically, the application will stand dismissed with costs to the respondent.
5) Mention on 19th June 2024 before the Deputy Registrar for compliance within (3)
6) Orders accordingly
