John Nderitu Gichuki VS Kenya National Highways Authority

High Court at Milimani High Court · · Anthony Ndungu

I have considered the chamber summons application herein, the statutory statement and verifying affidavit. Am satisfied that the leave sought is merited and i grant leave in terms of prayers 1 and 2.

As regards the plea that the leave do operate as a stay, am persuaded that the subject motor vehicle should be preserved pending the outcome of these proceedings and i therefore grant stay in terms of prayer 3. For avoidance of doubt such stay is not tantamount to an order for the release of the motor vehicle.

The substantive motion be taken out and served within 14 days. Responses be filed in 14 days of service.

Application be disposed of by way of written submissions. The applicant to file within 7 days of service of response and the respondent within 7 days of service of rival submissions.
