RULING
1. The Court notes that the application before the Court seeks for leave to institute a derivative action.
2. In the meantime, the Applicant has approached the Court to grant an interim relief by freezing funds held in the named Mpesa accounts.
3. The Court has been notified that there are proceedings going on before the Judicial Review division of the Court in HC JR E094 of 2026 exparte Edith Wambui Mwangi.
4. There are also criminal proceedings at Makadara in MCCR E1181 of 2026. Republic vs. Edith Wambui Mwangi.
5. It has been brought to the Court’s attention that the current case has been stayed by orders issued by the Hon. Justice Musyoka.
6. The Court is of the view that it is only fair that it hears both side fully before issuing any interim orders in this matter. This is because of the multiplicity of law suits.
7. The application is certified as urgent. The same will be heard on 19/5/2026. The parties to file written submission to the Preliminary Objections raised within 10 days each.
The parties to comply fully and matter will proceed by way of highlighting.
