The Respondent’s application dated 11.10.2022 is made under Paragraph 11(1) and (4) of the Advocates Remuneration Order. The Respondent seeks extension of time to file a reference from the decisions of the Deputy Registrar taxing the Auctioneers Bill of Costs. The application is struck out as it is made under Advocates Remuneration Order which does not apply to matter concerning Auctioneers. An Auctioneers Bill of Costs is not determined under the Advocates Remuneration Order as an Auctioneer is not an Advocate. Further, the Auctioneers Act and Rules thereunder do not incorporate the provisions of the Advocates Act and the Advocates Remuneration Order. A party who wishes to appeal is entitled to appeal against the decision of the Deputy Registrar may do so under Order 47 of the Civil Procedure Rules.
No order as to costs.
