1. I have considered the application dated 11.6.25 seeking transfer of the Kisii CM Succession cause no E121 of 2022 cause to this court for hearing and determination .
2. The succession cause was filed in the lower court whose pecuniary Jurisdiction is up to Kshs 20,million only .
3. It emerged in the ruling of the trial magistrate that the estate is value at about Kshs 46,000,000/= which is way above the jurisdiction of the Magistrates court .
4. The application is merited and i allow it as prayed. mention on for directions 1.10.25
