JOHN KAMAU MWANGI VS JOSEPHINE MUTINDA SHEM AND ROBERT ONGETA KINANGA

High Court at Milimani High Court · · M.S.Shariff

RULING

1. The Appellant has sworn one affidavit in support of two different applications: the Chamber Summons under consideration, in the first instance, dated 3.9.2026 and a Notice of Motion of even date. A Chamber Summons filed under the High Court Vacation Rules is a condition precedent to the admission of a substantive application for hearing during High Court Recess. This court has taken note of the laxity by the Appellant who has not found it fit to support his two applications with separate affidavits yet, the appellant craves that this court be called back to work from it's Recess to hear him. I do find that the application herein is incurably and fatally defective for joinder of affidavit and I hereby strike it out.

Delivered, Signed and Dated at Milimani Court this 8th day of September 2026.
