(1) Upon perusal of the letter by John Ndung’u Thuo dated 5-12-2025 and upon further hearing the oral submissions by Dennis who assists John Ndungu Thuo, I find it fair and just to amend the order dated 14-10-2025 as follows.
(a) The deceased Plaintiffs in this suit are hereby substituted with their respective beneficiaries as listed in the supporting affidavits and the Chief’s letter filed herein.
(b) The Deputy Registrar of this Court is hereby empowered to execute any instrument in place of the Defendant Njoroge Kangara (deceased) to give effect to the judgment and decree issued on 5-12-1980 and the order dated 5-3-1982.
(c) John Ndungu Thuo is hereby appointed as the lead Applicant and representative for the purposes of executing and coordinating the distribution of land on behalf of all the other beneficiaries as per the joint consent filed herein.
(d) The suit is reinstated pursuant to Order 12 rule 7 Civil Procedure Rules.
It is so ordered.
