Before Court is the Notice of Withdrawal of Suit dated 12th June 2026 and filed on behalf of the Petitioner by Mkan & Company Advocates, by which the Petitioner wholly withdrew and/or discontinued this suit against all the Respondents.
The Court record shows that the proceedings before Court were commenced as a constitutional and environmental petition in which the Petitioner sought, among other reliefs, conservatory orders to stop construction works on Plot No. MSA/XVIII/244, preservation orders, and production of statutory approvals and compliance documents from the Respondents. The supporting affidavit sets out that the dispute related to alleged environmental degradation, planning and construction irregularities, road reserve encroachment, lack of public participation, and public safety concerns arising from the impugned development.
The notice filed by the Petitioner is clear and unequivocal that the suit has been wholly withdrawn as against all the Respondents. In the absence of any matter remaining for determination in the Petition, the Court is satisfied that the withdrawal should be recorded accordingly.
Accordingly, the Court hereby records the withdrawal of this Petition and marks the same as wholly withdrawn. As requested, there shall be no order as to costs.

1. The Notice of Withdrawal of Suit dated 12th June 2026 be and is hereby adopted as duly filed and the withdrawal is recorded.
2. ELC Petition No. E012 of 2026 is hereby marked as wholly withdrawn.
