JOGINDER SINGH DHANJAL VS THE NATIONALPOLICE SERVICE AND THE DIRECTOR OF PUBLIC PROSECUTIONs AND 2 Others

High Court at Mombasa High Court · · Jairus Ngaah

' I have considered the applicant''s two applications both dated 1 September 2025. The first application seeks the second application, which is an application for leave for the applicant to file a motion for judicial review reliefs, to be admitted for hearing during this Honourable Court''s current recess. I am unable to admit the application and certify it urgent for the sole reason that the verifying affidavit is defective. While the deponent is indicated to be the applicant, Joginda Singh Dhanjal, the applicant''s counsel, Ayiro Chailu Edwin, has signed the affidavit in the jurat as the deponent. In these circumsatnces, the application is defective as it is not supported by an affidavit or a proper affidavit. The applicant may wish to withdraw this application and file a proper one but if he is intent on proceeding with it in its current form, it shall be mentioned on 24 September 2025 for directions on the manner of its disposal. It is so ordered.'
