JOGINDER SINGH DHANJAL VS THE NATIONALPOLICE SERVICE AND THE DIRECTOR OF PUBLIC PROSECUTIONs AND 2 Others

High Court at Mombasa High Court · · Gregory Mutai

1. I have read the Certificate of Urgency dated 30th January 2026 and the attached affidavit of Ms Wangeci Akedi , sworn on the said date. Counsel deposed that this Court fixed the applicant's application for hearing on 4th February 2026, whereas the Applicant is due to take plea on 3rd February 2026 . She contended that if plea taking is allowed to proceed, the substratum of the Judicial Review Proceedings will be rendered nugatory.
2. I have considered the said certificate of urgency carefully. The crux of the Notice of Motion application dated 27th January 2026 is the reinstatement of the interim orders that the Court set aside on 25th November 2025. Those orders stayed the proceedings in the Mombasa Criminal Case No. E1174 of 2025.
3. I am persuaded that the matter is urgent. It is in the interest of justice that the orders I previously issued, directing that the application dated 27th January 2026 be heard on 4th February 2026, be reviewed so that the hearing does not become an academic exercise. In the circumstances, I review the orders I issued on 29th January 2026 and order that the application dated 27th January 2026 be heard on 2nd February 2026 at 2pm. The applicant's counsel to serve the Respondents' counsel on or before 10 am on 2nd February 2026.
4. It is so ordered.
