RULING
The application coming up for hearing is the Chamber Summons dated 5/8/2024 brought by the Respondent in the appeal. The appellant filed a Replying Affidavit sworn on 24th September, 2024.
On the basis of the contents of the application, the Replying Affidavit and the oral submissions by Counsel for the appellant, the application is hereby allowed in terms of prayer 3 thereof. The Respondent (John Max Adwar) to deposit the security sum of Kshs 200,000/= in court within 14 days hereof failing which the stay of execution order pending appeal to the Court of Appeal granted earlier herein shall lapse. The earlier orders of this court issued on 20/6/2024 are varied accordingly.
