I have read the applicant's applications for leave to commence judicial review proceedings against the respondents and the application to admit the application for leave for disposal during this Honourable Court's August recess. Both applications are dated 19 August 2024 are filed under certificates of urgency of even date. I hereby certify the certificates urgent and further grant leave to the applicant to file a substantive motion for judicial review. The applicant is directed to file the main motion within seven days of the date of this ruling. The respondents shall file and serve their response to the motion within seven days of the date of service of the main motion. Directions on the hearing of the motion shall be given on 7 October 2024. The prayer for leave to operate as stay is declined for the reason that it is not apparent from the applicant's application the validity period for the firearms licence given under Firearms Certficate No. 9522. The court also notes that separate proceedings have been filed by the applicant in which question concerning issuance or validity period of firearms licence under Firearms Certificate No. 9522 may arise. Considering the material before court, these same questions may be directly or substantially in issue in the motion that will be filed. Orders accordingly.
