JEREMIAH ISIGI VS ATTORNEY GENERAL

Environment and Land Court at Kakamega Environment and Land Court · · Dalmas Ohungo

I have considered the application for adjournment and submissions by counsels. The record does not reflect well on the part of the Plaintiff. The Plaintiff has been granted adjournments on 16th January 2023, 6th March 2023, 18th May 2023, 4th December 2023 and 18th March 2024. Some of those adjournments were marked as last adjournments. On 18th March 2024, the Court warned parties to be ready to proceed at the next date.

Unfortunately, the Plaintiff is once again not ready to proceed. The Plaintiff must determine once and for all what documents he needs to produce.

Purely in the interest of justice and considering that the Second to Fourth Defendants have not opposed the application, I grant the Plaintiff the very last adjournment. The Plaintiff shall pay Court Adjournment Fees. Further hearing shall be on 25th November 2024 and 26th November 2024. Hearing Notice to issue.

Dated at Kakamega this 17th day of September 2024.
