The Court has considered the application dated 23rd September 2024 filed under a certificate of urgency. It is noted that the decree the applicant seeks to enforce by way of an order of mandamus emanates from the suit before the High Court of Kenya at Kitui in Civil Suit No. E004 of 2022 Jemmina Holdings Limited V. The County Government of Kitui and The County Assembly of Kitui.
In the Court\'s view, this application is wrongly filed in the Environment and Land Court since only the High Court has jurisdiction to enforce its judgement.
Consequently, the application dated 23rd September 2024 is hereby struck out with no order as to costs. The Applicant is at liberty to apply to the proper court.
