In the application dated 13.03.2023, the Applicant seeks to review of the order dated 24.02.2023 by the Deputy Registrar striking out a Bill of Costs dated 24.02.2023 in HC Misc. No. 326 of 2014 (OS). Since the Bill of Costs that was struck out is a Party and Party Bill, this application ought to have been filed in the matter where the judgment or decision awarding the costs was made.
This application is therefore incompetent and is therefore stuck out Costs to the Respondents assessed at Kshs. 5,000.00.
