1) The attention of this Honourable Court has been drawn to arithmetical errors in the court’s ruling delivered on 29th July 2025 herein.
2) The errors relate to accidental slip in terms of paragraph (1) ‘(a) (b) (b) (c) (d) (d) (e)’ which should be set out as ‘ (a) (b) (c) (d) (e) (f) and (g)’ respectively in the ruling.
3) Section 99 of the Civil procedure Act Chapter 21 Laws of Kenya provides;
‘Clerical or arithmetical mistakes in judgments, decrees or orders, or errors arising therein from any accidental slip or omission, may at any time be corrected by the court either of its own motion or on the application of any of the parties.’
4) This court subscribes to the decision in the case of Outa vs Okello & 3 others {2017} KESC 25 (KLR) where the Supreme Court of the Republic of Kenya opined that the main purpose of such a correction is to steer a Judgment,decision or order of the court;
‘........towards logical, or clerical perfection.............through the Slip Rule.........’
5) In that regard, the said errors which do not change the substance of this court’s decision, call for their correction to give effect the true intention of the court at the time the ruling was delivered; see Raniga vs Jivalji & another (1965} EA, 700 where the ‘Slip Rule’ was recognized.
6) The upshot is that the arithmetical errors contained in the ruling delivered on 29th July 2025 herein, are hereby corrected to show paragraph 1 (a) (b) (c) (d) (e) (f) and (g) in lieu of Paragraph 1 (a) (b) (b) (c) (d) (d) (e) accordingly.
7) It is so ordered.
