(ORIGINATING FROM CRIMINAL CASE NUMBER E732 OF 2024 IN

THE CHIEF MAGISTRATE’S COURT AT MOMBASA (Hon D Odhiambo)

  1. The Applicant was charged and convicted on his plea of guilty for the offence of  stealing of a motor cycle contrary to section 278 (A)  of the penal code. The Applicant was sentenced to three (3) YEARS imprisonment on the 6th day of  May  , 2024
  2. The sentence review report dated 30TH October, 2024 by NAFISA ABDALLA indicated that both his immediate family and the community at large are not receptive to his release from custody.      He was associated with other criminal activities and his chances of re offending were assessed as high.   His behavior was attributed to poor social economic background and environment .The family and community sentiments were negative  and they are not willing to receive him. His life is said to be in danger.
  3. Having considered the Sentence Review Report, I find that since the same is negative.  The offender should continue serving his sentence.
  4. The application for sentence review is dismissed.
