JACKSON YIANGASO TOIYANGA AND WILFRED KELENYI TOIYANGA VS State Law Office AND National Police Service Commission (NPSC) AND 1 Others

High Court at Milimani High Court · · Bahati Mwamuye MBS

  1. The Notice of Motion Application dated 17/02/2025 in this matter does not feature a header indicating the Parties. Whereas the other pleadings filed indicate the parties, the Notice of Motion Application, absent of the same, is irregular and incurably defective. The Court also notes there are instances where the Parties in an interlocutory application differ from those in the main suit/petition. Consequently, the Court cannot proceed with the Application as drafted, and as it goes to a substantive issue the same is not a procedural technicality that the Court can use its inherent powers to cure.
  2. For good order, the same is struck out without prejudice; and liberty to re-file a competent and regular Application is granted.
  3. Notice of Motion Application dated 17/02/2025 is struck out with no orders as to costs; and outcome accordingly.
