I have considered the application and the submissions. I note that this is the second time the application is coming up. The Applicant sought and was granted adjournment on 5th March 2024 on account of failure to serve the Second and Third Respondents.
Purely in the interest of justice, I grant the Applicant the last adjournment. The Applicant shall pay Court Adjournment Fees and the First Respondent’s costs for today which I asses at KShs 5,000 (Five Thousand) before the next date. Notice of Motion dated 14th February 2024 shall be heard on 15th October 2024. Hearing Notice to issue.
