RULING

1. The Court has considered the application for joinder by the Applicants as well as the Replying Affidavit dated 26.06.2025 by the Respondent.
2. The question to be answered in the determination of this application is whether the Applicants have any basis to form the proceeding and/or assist the court in the determination of the issues in the Petition.
3. To begin with, the property in dispute is ELDORET MUNICIPALITY BLOCK 10/1909 which was registered in the names of Jackson Kiprotich Kibor and Eunitah Jelimo Bor on the 30.11.2017.
4. The person known as Jackson Kiprotich Kibor has since passed away and the surviving registered the Petition.
5. In essence therefore, the Applicants have no locus standi to be joined in this Petition as there is no demonstration of what interest they have in this file.
6. The Applicants are condemned to pay costs to the Petitioner/Respondent.
