1. The parties came to court and filed consent to arrest the judgment which was pending with a view to settling the matter amicably out of court.
2. At that point, the court informed the parties that it had already embarked on writing the judgment but due to the request, it allowed them an opportunity to do the negotiations.
3. It would appear however, in view of today’s court session, that there is very little, if any, progress that has been made due to mistrust.
4. The court is worried that the parties may not reach a settlement in time if this continues.
5. The responsibility of this court is to settle disputes if the parties cannot agree.
6. The court cannot thus keep extending time to the parties when it is apparent that there is no good faith in finalizing their negotiations.
7. I thus extend the last opportunity to the parties to conclude their negotiations, failing which, the court shall proceed and pronounce judgment in this case.
8. Mention on 3rd June, 2025. In the event that no settlement is reached, Judgment on 5th June, 2025.
Dated, signed and delivered virtually at Nairobi this 19th day of May, 2025.
