RULING
1. This matter relates to the property known as Eldoret Municipality Block 12/621 and 622 belonging to the 1st Defendant.
2. Currently, the 1st Defendant assets are the subject of the proceeding known as Nairobi HCACECS No. E035 of 2025 which has been instituted by the proposed interested party known as Assets Recovery Agency.
3. It is therefore important for avoidance of conflicting decisions over the properties known as Eldoret Municipality Block 12/621 and 622, that this file be placed before the Court handling the Asset Recovery matter.
4. In the event the High Court is of the view that the ownership of these properties is still an issue for determination, it will be at liberty to refer back this matter for hearing before this Court taking note of the same in its proceedings.
5. The matter will be mentioned on 13.05.2026 before the Court handling the proceeding known as HCACEC Application No.E035 of 2025 in Nairobi.
6. The Deputy Registrar ELC Eldoret will ensure transmission of this file expeditiously.
