I have considered Notice of Motion dated 28th March 2024 and the supporting affidavit. The application is not opposed. It was also served upon the Land Registrar who has equally not filed any response.

I find merit in the application. I make the following orders:

  1. The Land Registrar Kakamega is hereby directed to withdraw the caution registered as entry number 5 dated 16th December 2022 against title number Kakamega/Kongoni/2063.
  2. No order as to costs of Notice of Motion dated 28th March 2024.
  3. This miscellaneous cause is marked closed on those terms.
