IPROCURE LIMITED VS Office of the Official Receiver

High Court at Milimani High Court · · Githiru Freda Mugambi

1. Before court is the application dated 24th April 2025. It seeks to have the term of the administrator extended for a period of six (6) months. The application is made pursuant to section 594(1) of the Insolvency Act. It is supported by the affidavit of Anthony Makenzi Muthusi, the administrator, sworn on 24th April 2025, together with the annexed report. I note that the application is not opposed by any of the parties.

2. I have considered it alongside the affidavit in support. I note that the administration had been extended in the interim pending the hearing and determination of this application. The application is justified and is therefore granted. The administrator’s term of office is hereby extended pursuant to section 594 (1) of the Insolvency Act for a period of 6 months from 5th June, 2025.

3. As a direct result, I deem it fair and just to equally extend the statutory moratorium for a further 6 months so as to allow the completion of the administrative process.

4. In the meantime, the applicant in the application dated 20th March 2025, as well as any other creditor, is advised to engage directly with the administrator with a view to exploring the possibility of settling their claims within the framework of the ongoing administration.

5. The matter shall be mentioned on 27th November 2025 for further directions, to confirm the completion of the administration process. Liberty is granted to any party to apply as the need may arise.

DATED, SIGNED AND DELIVERED IN NAIROBI
THIS 26TH DAY OF MAY 2025.
