On 10th July 2024, the Court revoked earlier grant and issued fresh grant to Anne Mumbi Njoroge and Francis Ngotho Githu as joint administrators and directed that they file summons to provide for interest of the Applicant herein RAPHAEL MBUCHO MUHIA pursuant to ruling delivered on 6th October, 2023. The Administrators failed to comply with directions of the Court hence the Applicant vide application dated 3rd June, 2025 has moved the Court to rectify the Certificate of Confirmation of Grant issued herein on 12th March, 2007.
That application is not opposed by the Administrators. Accordingly, the following orders shall issue; -
The orders of 12th March, 2007 are varied and the estate be distributed as follows;
Beatrice Wanjiku Githu 2.1968 Acre portion of LR No. Kiganjo/Nembu/1157. To be registed in her name absolutely.
Anne Mumbi Njoroge – 0.21 Acre portion of L.R No. Kiganjo/Nembu/1157 – To be registered in her name absolutely.
Estate of Anthony Muhuhu Githu 1.6968 Acre portion of L.R N. Kiganjo/Nembu/1157 – To be registered in his name absolutely.
Raphael Mbucho Muhia 2.5 Acre portion of L.R No. Kiganjo/Nembu/1157 – To be registered in his name absolutely.
Francis Ngotho Githu – 4.1968 Acre portion of LR No. Kiganjo/Nembu/1157 – To be registered in his name absolutely.
Mary Wangui Githu 2.1968 Acre portion of LR No. Kiganjo/Nembu/1157 – To be registered in her name absolutely.
The Administrators to finalise transmission of the estate within 3 months.
In the event that the Administrators fail to initiate the process of transmission within 3 months the Applicant, Raphael Mbucho Muhia, shall present to the Deputy Registrar documents for execution to facilitate transmission.
The Applicant will have costs of this application awarded at Kshs.25,000 payable within 30 days.
Any party exercising their right of appeal to do so within 30 days.
