RULING
- This matter was pending judgment. Although the court directed that the matter be disposed by way of written submissions, I have now perused the file and the written submissions filed. Upon further reflection it is my considered opinion upon further reflection that this is a matter that merits hearing by way of vive voce evidence at which witnesses will be called and cross-examined as there arise certain critical issues which need proper elucidation i.e the names and identities of all the beneficiaries and the circumstances under which the property LR AGUTHI/GATITU/174 was sub-divided and transferred.
- For the above reason I have not prepared a judgement. The matter will be given an early hearing date as I am mindful of the age of this matter.
