1.I have perused the application dated 16/10/2024. I do not certify it as urgent since the matter is scheduled for mention on 28/10/2024 to confirm the filing of summons for confirmation of grant.
2.Further, the applicant does not state when he is to travel to India since the Authorization in August. Additionally, as the Petitioner appears unwell, rushing to confirm the grant will not aid the estate which requires administration and distribution.
3.I direct the family of the deceased Walter Henry Odera to appoint two other persons to be enjoined to this Petition for purposes of administering the estate in the absence of the Petitioner who shall be proceeding for intense medical attention as disclosed in his affidavit. This will ensure that the administration of the deceased\'s state continues as the administrator has timelines within which to fully distribute the estate and file accounts into court.
4. As the summons for confirmation of grant is filed, the applicant to be notified to comply with the above directions and avail all beneficiaries on 28/10/2024 for confirmation of the grant.
