Ruling
I have seen the mediation settlement agreement between the parties dated 18.11.24 settling the applications dated 28.9.2023 & 15.9.23 on the following terms :
‘’We, the undersigned parties in this matter, have agreed to settle our dispute/differences as follows:
1. THAT the parties agree that the 3 families share in equal portions of L.R. No .Nyansiongo Settlement Scheme/106
2. THAT the distribution will be as follows:
(a) Mrs. Tabitha Nyaboke Ouko the 3rd household to be administered by Hellen Mong’ina Ouko.
(b) Mrs. Eunice Moraa Ouko –The 4th Household to be administered by Albert Omwocha Ouko.
(c) Mrs. Agnes Nyang’ate Ouko, the surviving wife.
(d) THAT the County Surveyor Nyamira Survey Office undertake the survey works within 14 days from the date of this consent.
(e) THAT the costs of the sub-division to be shared equally among the 3 household.
(f) THAT the parties have agreed not to interfere with the boundaries once fixed by the surveyor.
(g) THAT the parties have also agreed that anybody who interferes with the boundaries once fixed will face penal consequences.
(h) THAT the parties have agreed to freely sign this consent. ‘’
I proceed to adopt the said agreement as orders of this court . The grant confirmed on 30.4.19 is hereby revoked . Fresh grant of letters of administration and confirmed grant to issue accordingly .
