' 1. I have perused the Petition for a limited grant ad litem dated 7th October 2025 filed by the Petitioner, Geraldine Mary Carvalho , the widow and heir of Richard Joseph Carvalho , the deceased person. Mrs Carvalho deposed that she is in Kenya on a temporary visa and may have to leave the jurisdcition of this Court soon. She has prayed for a limited grant ad litem to enable her to collect the balance of the sale price of Title No Kwale/Galu/Kinonondo/3882, which had been sold to one Franscesco Giuseppe Cecchini, for Kes.25,000,000/- and for purposes of taking over or continuing court proceedings in which the deceased had an interest.
2. I am persuaded, based on the documents I have seen, that the applicant is indeed the widow of the deceased and his legal heir. Given the pending litigation it is necessary that the estate of the deceased be protected and that there be an administrator while the succession proceedings are ongoing.
3. In the circumstances, I order that a grant ad litem do issue to the petitioner/applicant forthwith, limited to receiving the balance of the purchase price and to representing the estate of the deceased in pending litigation.
4. The sale proceeds shall be deposited in an account in Kenya and shall be preserved until the full grant is issued by the Court. The administrator ad litem shall not have the power to use the said sale proceeds, to sell or charge or otherwise alienate the properties of the deceased, movable or immovable, until the full grant is issued AND confirmed by this Court. I direct the petitioner/administrator ad litem to file a petition for the full grant within 7 days of the date hereof, failing which the grant issued herein will lapse automatically.
5. It is so ordered.
