RULING
I have heard both parties on the objection . The practice in the common wealth is that the fact that a witness is seated in court during hearing of the witnesses who testified before them is not a ground for disqualification of a witness , what happens is that it is notes that they were seated in court and they are allowed to testify and at the time of evaluation of evidence it is considered that they were seated in court during testimony. I note that the said witnesses i.e are Margaret Kwamboka Nyambaro, Kennedy Nyantari , Jenny Otundo Nyantari were seated in court during the testimony of Dw1.
